Cutting down a tree or putting a pool in your backyard isn’t something you do without checking the rules. In Brossard, both are governed by municipal regulations, and pools also by a Government of Quebec regulation.
Tree cutting: when do you need a certificate?
- for any tree with a trunk 10 cm in diameter or more, measured 1.30 m above the ground;
- for any cutting or pruning of an ash tree, whatever its size.
The certificate is free and valid for 3 months. You apply online with the City’s permit application. Have a photo of the tree ready, a professional’s report if your reason requires one and, in a condo, authorization from the syndicate.
Accepted reasons
- dead, diseased or infested tree (professional report required);
- dangerous tree, when cutting it down is the only solution (report required);
- deciduous tree less than 1.5 m from a building or pool, conifer less than 3 m away;
- tree causing damage to the property or preventing authorized work;
- tree harming the survival of a neighbouring tree, or a species with restricted planting.
Leaves, fruit, shade, sap, pollen or insects are not considered sufficient nuisances.
Replacing the tree
If the tree you cut down counted toward the minimum number required on your lot, it must be replaced within 12 months. The new tree must reach at least 7 m at maturity; thujas (cedars) don’t count. Branches go to the ecocentre: see ecocentres and bulky items.
Residential pools
In Quebec, installing a pool, whether in-ground, semi-in-ground or above-ground, is governed by the Regulation respecting residential swimming pool safety. A municipal permit is required before installing or replacing a pool and before building its enclosure. Since July 1, 2023, pools installed before 2010 must also meet the safety standards. Learn more on Québec.ca.
Brossard’s rules for the enclosure
- a fence must prevent access to the pool;
- the gap between the ground and the bottom of the fence must not exceed 10 cm;
- removable fences are allowed for single-family homes, inside the lot, and must stay in place at all times;
- snow fences and temporary fences are not allowed around a pool;
- a minimum distance of 1 m is required between the pool and any other structure.
Spas and hot tubs also have their own rules: check with the City’s urban planning department before buying.
